These terms and conditions outline the rules and regulations for the use of Parcelcraft’s website, located at https://www.parcelcraft.com, and for the use of the Parcelcraft app, available through the Stripe Apps Marketplace.

By accessing this website, or using our app, we assume you accept these terms and conditions. Do not continue to use parcelcraft.com or use our app if you do not agree to take all of the terms and conditions stated on this page.

The following terminology applies to these Terms and Conditions, Privacy Statement and Disclaimer Notice and all Agreements: “Client”, “You” and “Your” refers to you, the person logging on to this website and compliant to the Company’s terms and conditions. “The Company”, “Ourselves”, “We”, “Our” and “Us”, refers to our Company. “Party”, “Parties”, or “Us”, refers to both the Client and ourselves. All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner for the express purpose of meeting the Client’s needs in respect of provision of the Company’s stated services, in accordance with and subject to, prevailing law. Any use of the above terminology or other words in the singular, plural, capitalization and/or they, are taken as interchangeable and therefore as referring to the same.

Acceptance of terms

By accessing or using the app or our website, you confirm your acceptance of these Terms and your agreement to be legally bound by them. If you do not agree to these Terms, we revoke our permission to use our app and website.

Services

The app allows you to create shipping labels from several carriers including, but not limited to, FedEx, UPS, USPS, Canada Post, DHL and numerous others (“Carriers”).

Third-party terms of service

Our app utilizes the EasyPost API to create shipping labels. By using our app, you agree to be bound by the EasyPost API Terms and Conditions, which can be found at https://www.easypost.com/legal/terms. We encourage you to review them carefully.

In addition to the EasyPost API Terms and Conditions, by using our app, you also agree to be bound by the terms and conditions of the Carriers. These can typically be found on the respective websites of the Carriers. It is your responsibility to review and abide by these third-party terms and conditions.

User responsibility

You acknowledge and agree that you are solely responsible for all charges, fees, duties, taxes, and assessments arising out of any use of our app.

Use of Stripe app and customer data

Our application integrates with Stripe and has access to certain private information, including data about your customers. We treat this information as protected and confidential. Here’s how we use this data:

1. Shipment creation. We use the data accessed through our Stripe app solely to create shipments based on your order information.
2. Shipment history. We retain and use the resulting shipment information to provide a comprehensive shipment history within our application.
3. Customer communications. We assume permission to email your customers directly in the following circumstances:
   • To provide tracking information when a shipment is sent.
   • To notify them of shipment cancellations.
   • To deliver return labels when necessary.
   You can turn off the sending of customer-facing emails in the app; you can also connect your own SendGrid account and customized templates to remove our ability to send your customers these notification emails. We do not email your customers in any other circumstance. Our partner, EasyPost, and the carrier you select will have information about your shipment, enabling the carrier to notify them about incoming shipments — for example, UPS or USPS may inform customers about pending shipment arrivals.
4. Data protection. We do not share this protected information with any third parties beyond EasyPost or the carrier you select for shipment. All data is used exclusively for the purposes stated above and to improve our service to you.
5. Data retention. We retain this information only for as long as necessary to provide our services and maintain your shipment history, or as required by applicable laws and regulations.

By using our application, you acknowledge and agree to our use of this data as described above. You are responsible for ensuring that your use of our application, including the customer communications we send on your behalf, complies with your own privacy policies and applicable laws and regulations.

Free trial policy

• Your free trial includes 25 free shipments or 90 days, whichever comes first.
• The trial is shared across all users in your Stripe company.
• Once your company reaches 25 shipments or 90 days have passed since the first user activated the trial, the trial will expire for all users in your company.
• If you are part of multiple Stripe companies, each company will have its own independent trial.

Cookies

We employ the use of cookies. By accessing parcelcraft.com, you agree to the use of cookies in accordance with Parcelcraft’s Privacy Policy.

Cookies are used by our website to keep you signed in and to enable the functionality of certain areas of the app. See the Privacy Policy for the specific cookies we set and how long they last.

Unless otherwise stated, Parcelcraft and/or its licensors own the intellectual property rights for all material on parcelcraft.com. All intellectual property rights are reserved. You may access this from parcelcraft.com for your own personal use subject to the restrictions set in these terms and conditions.

We do not ensure that the information on this website is correct, we do not warrant its completeness or accuracy; nor do we promise to ensure that the website remains available or that the material on the website is kept up to date.

Disclaimer

To the maximum extent permitted by applicable law, we exclude all representations, warranties and conditions relating to our website and the use of this website. Nothing in this disclaimer will:

• limit or exclude our or your liability for death or personal injury;
• limit or exclude our or your liability for fraud or fraudulent misrepresentation;
• limit any of our or your liabilities in any way that is not permitted under applicable law; or
• exclude any of our or your liabilities that may not be excluded under applicable law.

The limitations and prohibitions of liability set in this section and elsewhere in this disclaimer: (a) are subject to the preceding paragraph; and (b) govern all liabilities arising under the disclaimer, including liabilities arising in contract, in tort and for breach of statutory duty.

As long as the website and the information and services on the website are provided free of charge, we will not be liable for any loss or damage of any nature.
